We make federal opportunities easier to discover, but SAM.gov remains the official source. Data and alerts can be incomplete, delayed, duplicated, or unavailable. Always verify the full notice, amendments, attachments, eligibility rules, and deadlines on SAM.gov. We do not promise an award and do not provide legal, procurement, or compliance advice.
These Terms of Use (“Terms”) form a binding agreement between you and the private operator of SAM Opportunity Search (“SAM Opportunity Search,” “we,” “us,” or “our”) and govern your access to and use of our websites, search tools, accounts, opportunity alerts, paid plans, and related services (collectively, the “Service”). Our Privacy Policy explains how we handle personal information and is incorporated by reference.
01 Agreement and eligibility
By accessing or using the Service, creating an account, saving an alert, or purchasing a plan, you acknowledge that you have read and agree to these Terms. If you do not agree, do not use the Service. If you use the Service for a company, agency, or other organization, you represent that you are authorized to bind it, and “you” includes that organization.
You must be at least 18 years old and legally capable of entering a binding agreement. You may not use the Service if doing so is prohibited by applicable law, sanctions, export restrictions, contract, or an obligation you owe to another party.
02 What the Service does
The Service helps users search, filter, review, save criteria for, and receive alerts about U.S. federal contracting opportunities. Search tools may use live responses from the SAM.gov Opportunities API, saved responses, and official public data snapshots. Results may include highlights such as agency, solicitation number, dates, NAICS or PSC code, place of performance, set-aside, notice type, and a direct link to the source record.
SAM Opportunity Search is not SAM.gov, not a government agency, and not affiliated with, sponsored by, or endorsed by the U.S. government. “SAM.gov” and other third-party names and marks belong to their respective owners.
The Service may include an automated chatbot that translates natural-language requests into search filters, triggers local searches or alert settings, and provides brief educational answers. Chatbot responses and extracted criteria are generated automatically, can misunderstand your request, and are not a substitute for reviewing the official record or obtaining professional advice. The chatbot is intentionally not a proposal-writing service.
Public landing pages may offer an anonymous preview limited to two chatbot inputs during a rolling 24-hour session. We may change, suspend, or further restrict preview limits to protect source systems, security, performance, and operating costs. You may not clear, alter, automate, or otherwise circumvent a cookie, counter, or other control used to enforce a limit.
03 Official records control
The Service is a discovery interface, not the official contract-opportunity record. SAM.gov and the issuing agency’s materials control if any Service result, summary, label, link, date, code, alert, cache, or other presentation differs from the official notice. The Service may not display every field, attachment, amendment, question-and-answer update, cancellation, archive status, or version.
Government data can be corrected, revised, withdrawn, delayed, rate-limited, or temporarily unavailable without notice. Live API results may be paginated. Saved results and public snapshots may be incomplete or stale. Links can change or fail. We do not control SAM.gov, any issuing agency, or the timing and content of government publications.
04 Your contracting responsibility
You are solely responsible for evaluating each opportunity and preparing, reviewing, and submitting any response. Before relying on a result, you must open the official record and independently confirm, among other things:
- the current deadline, time zone, delivery method, and amendment history;
- the full solicitation, attachments, clauses, instructions, evaluation criteria, and questions-and-answers;
- eligibility, registration, representations and certifications, security, socioeconomic, licensing, bonding, insurance, export-control, and responsibility requirements;
- applicable NAICS, PSC, size standard, set-aside, place of performance, and agency-specific rules; and
- that the government system accepted a complete and timely submission.
We do not provide legal, tax, accounting, procurement, cybersecurity, regulatory, socioeconomic-status, size-standard, proposal, or other professional advice. Search results are not a recommendation that an opportunity fits your business. We do not guarantee eligibility, responsiveness, responsibility, submission acceptance, competitive position, revenue, contract award, or any other outcome. Consult qualified advisers and the contracting officer when appropriate.
05 Accounts and security
Some features require authentication through a third-party identity provider. You must provide accurate information, maintain authorized access to the email and identity account used to sign in, protect your devices and sessions, and promptly notify us of suspected unauthorized use. You are responsible for activity under your account unless applicable law provides otherwise.
Accounts are personal to the authorized user or organization and may not be sold, transferred, or shared in a way that circumvents plan limits or security controls. We may rely on instructions received through an authenticated session. We may require reauthentication or additional verification before sensitive account, billing, privacy, or security actions.
06 Alerts, email, and SMS
Best-effort alerts
Saved searches and alerts are convenience features only. Matching depends on the criteria you enter, government source data, system schedules, provider availability, and plan limits. Alerts may be delayed, incomplete, duplicated, out of order, or not delivered. Filters may include or exclude notices you did not expect. Never use an alert as your only method of monitoring an opportunity or deadline.
By enabling email alerts, you request recurring opportunity-match messages at the address you provide. You can disable them in Alert settings or use the unsubscribe link in an alert email. Disabling alert email does not prevent essential account, security, billing, transactional, or legal communications where permitted by law.
SMS program terms
By enabling SMS, entering a mobile number, and checking the express-consent box, you authorize SAM Opportunity Search to send recurring automated informational text messages about opportunity matches and alert administration to that number. Message frequency varies based on your selected schedule and available matches. Message and data rates may apply. Consent to SMS is optional and is not a condition of purchasing a subscription; email delivery may be used instead.
- You represent that you are the subscriber or customary user of the number and are authorized to consent.
- Reply STOP to cancel SMS alerts. Reply HELP for help. You may also disable SMS in Alert settings.
- We may send one confirmation after an opt-out. You must provide fresh consent before SMS alerts resume.
- Carriers are not liable for delayed or undelivered messages. Delivery depends on carrier and provider availability.
- If a number changes ownership or you no longer control it, disable SMS and update your account immediately.

07 Paid subscriptions
SAM Opportunity Search offers a $14.95 monthly plan and a discounted $99 annual plan, plus applicable taxes. Included features, usage limits, promotions, and any different plan terms are shown at Stripe Checkout or in a plan order and are incorporated into these Terms. We do not receive your full payment-card number and will not charge you until you authorize payment through checkout.
Entering an email on a public opportunity page reserves the selected tracker criteria and opens secure checkout. It does not by itself authorize a charge. A paid subscription begins only after you submit payment authorization and Stripe confirms the transaction; alert delivery begins after successful payment and account setup.
Renewal and authorization
Unless checkout expressly describes a plan as non-renewing, a paid subscription renews automatically for successive periods of the same length until canceled. You authorize us and our payment processor to charge the payment method on file at the start of each renewal period, plus applicable taxes. We will provide renewal notices where required by law.
Cancellation and refunds
You may cancel through the account or cancellation method made available with the plan. Cancel before the renewal date to avoid the next charge. Unless checkout, a written refund policy, or applicable law says otherwise, cancellation takes effect at the end of the current paid period and fees are non-refundable and not prorated. If we discontinue a paid plan during a prepaid term for reasons unrelated to your breach, we will provide a prorated refund or reasonably comparable service.
Changes, failed payments, and taxes
We may change plan features, limits, or prices prospectively. A price increase for an existing subscription will take effect no earlier than the next renewal after reasonable advance notice, subject to law. You are responsible for applicable taxes other than taxes on our net income. If payment fails, we may retry the charge and suspend or downgrade paid features after notice. Promotions and trials may have additional disclosed conditions and may convert to a paid plan only as clearly disclosed and authorized.
08 Acceptable use
You may use the Service only lawfully and in accordance with these Terms. You may not:
- access another person’s account or misrepresent identity, authority, affiliation, eligibility, or business status;
- interfere with, overload, disrupt, probe, scan, or test the Service or related systems without written authorization;
- introduce malware, harmful code, fraudulent traffic, or content that violates law or third-party rights;
- evade rate limits, access controls, plan limits, authentication, opt-outs, security measures, or provider restrictions;
- use bots, crawlers, scrapers, or automated requests in a way that imposes unreasonable load, violates source terms, or degrades availability; ordinary browser use and expressly authorized integrations remain permitted;
- reverse engineer, decompile, or attempt to extract nonpublic source code, secrets, credentials, or data, except to the limited extent a restriction is prohibited by law;
- use the Service to send unsolicited, unlawful, deceptive, or unwanted communications or to submit someone else’s contact details without authority and valid consent;
- resell, sublicense, frame, white-label, or commercially exploit the Service itself without written permission; or
- use the Service or its outputs to violate procurement integrity, antitrust, export-control, sanctions, anti-bribery, cybersecurity, records, or other applicable requirements.
Reasonable use of public opportunity information obtained from the official source remains subject to the source’s terms and applicable law.
09 Inputs and feedback
You retain any rights you have in search criteria, saved-alert names, support messages, and other information you submit (“Inputs”). You grant us a limited, worldwide license to host, copy, transmit, format, and process Inputs only as needed to operate, secure, support, and improve the Service, comply with law, and enforce these Terms. You represent that you have the necessary rights and authority to provide the Inputs and that they do not contain material you are prohibited from disclosing.
Do not enter classified, controlled unclassified, export-controlled, source-selection-sensitive, proprietary, personal, or other confidential information into search fields. Search criteria may appear in URLs, browser history, shared links, and technical logs.
If a search returns active results, we may use sanitized, non-personal structured criteria—such as keywords, NAICS codes, and recognized locations—to create or refresh a public search landing page and sitemap entry. We do not intentionally publish raw chatbot messages or contact details through that process, and we may reject, edit, de-index, or remove any candidate page.
If you voluntarily provide ideas or feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use it without restriction or compensation, without identifying you publicly unless you agree.
10 Intellectual property
The Service’s software, interface, original text, layout, graphics, branding, and other proprietary materials are owned by us or our licensors and protected by applicable law. Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable right to use the Service for your internal personal or business opportunity research.
Public government records and third-party content remain subject to their own legal status, licenses, and terms. Displaying or linking to them does not transfer ownership to us or to you. You may not use our name, logo, or branding to imply sponsorship, endorsement, affiliation, or government status.
11 Third-party services
The Service depends on or links to third parties, including SAM.gov and government data systems, hosting and database infrastructure, authentication, payment, email, SMS, carriers, and external websites. We do not control those services and are not responsible for their content, terms, privacy practices, security, availability, acts, or omissions. Your use of a third-party service may be governed by a separate agreement with that provider.
12 Availability and changes
We may add, remove, limit, suspend, or modify features, data sources, providers, plans, quotas, or eligibility requirements. We may perform maintenance or respond to security, legal, provider, or government-system issues without advance notice. We do not guarantee continuous, error-free, secure, or geographically available operation. Beta, prototype, preview, or newly introduced features may change materially and may contain defects.
Events outside reasonable control—including government outages, API limits, provider failures, carrier filtering, internet disruptions, labor disputes, disasters, war, terrorism, civil disorder, epidemics, and governmental action—may delay or prevent performance. We are not liable for delay or failure caused by such events to the extent permitted by law.
13 Suspension and termination
You may stop using the Service at any time and may cancel paid plans as described above. We may suspend, limit, or terminate access if we reasonably believe you violated these Terms, created risk or liability, failed to pay, abused a provider or government system, threatened security or availability, or if continued access would violate law or a provider requirement. Where practical and appropriate, we will provide notice and an opportunity to cure.
Upon termination, your right to use the Service ends. Provisions that by their nature should survive—including ownership, payment obligations, disclaimers, liability limits, indemnity, dispute terms, and general provisions—will survive. Data handling after termination is governed by the Privacy Policy and applicable law.
14 Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL RESULTS, ALERTS, DATA, LINKS, SUMMARIES, AND FEATURES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE AND OUR LICENSORS AND PROVIDERS DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, TIMELINESS, SECURITY, AVAILABILITY, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT A SEARCH, CHATBOT RESPONSE, EXTRACTED FILTER, OR ALERT WILL FIND EVERY RELEVANT OPPORTUNITY; THAT DATA, CLASSIFICATIONS, DEADLINES, LINKS, OR AUTOMATED ANSWERS ARE CORRECT OR CURRENT; THAT A MESSAGE WILL BE DELIVERED; THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; OR THAT USE WILL RESULT IN ELIGIBILITY, SUBMISSION ACCEPTANCE, REVENUE, OR AN AWARD.
Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you. Nothing in these Terms limits rights that cannot lawfully be waived.
15 Limits on liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST PROFITS, REVENUE, SAVINGS, DATA, BUSINESS, GOODWILL, OR OPPORTUNITIES; PROCUREMENT OR PROPOSAL COSTS; MISSED DEADLINES; FAILED OR REJECTED SUBMISSIONS; LOST AWARDS; OR COSTS OF SUBSTITUTE SERVICES, EVEN IF ADVISED THAT SUCH DAMAGE IS POSSIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) US$100 OR (B) THE AMOUNT YOU PAID US FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These limits apply regardless of legal theory and even if a remedy fails of its essential purpose. They do not limit liability that cannot legally be limited, which may include liability for fraud, willful misconduct, gross negligence, or personal injury in some jurisdictions.
16 Indemnity
To the extent permitted by law, you will defend, indemnify, and hold harmless SAM Opportunity Search and its owners, officers, employees, contractors, licensors, and providers from third-party claims, damages, losses, judgments, liabilities, costs, and reasonable attorneys’ fees arising from your Inputs, your violation of these Terms or law, your misuse of the Service, communications sent through your account, or your infringement or violation of another person’s rights. We may control the defense and settlement of an indemnified claim, and you will reasonably cooperate. We will not settle a claim imposing a non-monetary obligation on you without your consent, not to be unreasonably withheld.
17 Disputes and governing law
Informal resolution first
Before filing a claim, each party agrees to send a written notice describing the dispute and requested resolution and to try in good faith for 30 days to resolve it. Send notices to legal@samopportunitysearch.com. This requirement does not prevent either party from seeking urgent injunctive relief, using an eligible small-claims process, or meeting a legal filing deadline.
Law and forum
These Terms are governed by the laws of the U.S. state in which the Service operator maintains its principal place of business, without regard to conflict-of-law rules. Subject to rights that cannot be waived, judicial proceedings must be brought in the state or federal courts serving that principal place of business, and each party consents to personal jurisdiction there. If applicable consumer law entitles you to another governing law or forum, that mandatory right controls.
18 General terms
- Entire agreement. These Terms, the Privacy Policy, checkout terms, and any expressly incorporated policies form the entire agreement about the Service and replace prior or contemporaneous understandings on that subject.
- Order of precedence. Specific checkout or plan terms control over these Terms only for the specific conflict; otherwise these Terms control.
- Severability. If a provision is unenforceable, it will be enforced to the maximum lawful extent or modified minimally, and the remaining provisions remain effective.
- No waiver. Failure to enforce a provision is not a waiver. A waiver must be in writing and applies only to the stated instance.
- Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a reorganization, financing, sale, merger, or transfer of the Service, subject to law.
- No third-party beneficiaries. Except for parties expressly protected by the disclaimers, liability limits, and indemnity, these Terms create no third-party beneficiary rights.
- Electronic communications. You consent to receive agreements, disclosures, notices, and records electronically. You may retain copies for your records.
- Headings. Headings and summaries aid reading and do not limit the operative text.
19 Changes and contact
We may update these Terms. We will post the revised Terms, update the date above, and provide additional notice when required by law or when a change materially reduces existing paid-user rights. Changes apply prospectively from their effective date. If you do not agree to revised Terms, stop using the Service and cancel before the next renewal. Continued use after the effective date constitutes acceptance to the extent permitted by law.
